CONSUMER RIGHTS – RIGHT OF WITHDRAWAL – CANCELLATION & RETURN CONDITIONS

GENERAL PROVISIONS

When you place an order electronically through the website you are using, you are deemed to have accepted the Preliminary Information Form and the Distance Sales Contract presented to you.
Buyers are subject to the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts regarding the sale and delivery of the products they purchase.
Shipping costs are not charged to the buyer; free shipping is applied throughout Turkey.
Each purchased product is delivered to the person/institution at the address specified by the buyer, provided that the legal period of 30 days is not exceeded. If delivery is not made within this period, the buyer may terminate the contract.
The seller is obliged to deliver the product in full, in accordance with the specifications stated in the order, and with a warranty certificate, if any.
If delivery of the product becomes impossible, the seller informs the buyer within 3 days from the date of becoming aware of the situation and refunds the product price within 14 days.

IF THE PURCHASED PRODUCT PRICE IS NOT PAID

If the buyer does not pay the product price or if the payment is cancelled in bank records, the seller’s obligation to deliver the product ends.

UNAUTHORIZED USE OF CREDIT CARD

If, after the product is delivered, it is determined that the credit card used for payment was used by unauthorized persons and the sales amount is not paid to the seller by the relevant bank, the buyer is obliged to return the product within 3 days, with the shipping cost borne by the seller.

FORCE MAJEURE AND DELIVERY

If force majeure events that the seller cannot foresee occur and the product cannot be delivered on time, the buyer is informed. The buyer has the following rights:

• To cancel the order

• To request replacement with a similar product

• To postpone delivery until the obstacle is removed

In case the order is cancelled:

• If the payment was made in cash, it will be refunded within 14 days.

• If the payment was made by credit card, the refund will be made to the bank within 14 days. The reflection of the refund to the card may take 2–3 weeks depending on the bank.

BUYER’S OBLIGATION TO CHECK THE PRODUCT

The buyer must check the product before receiving it and must return broken, crushed or damaged products to the cargo officer. After delivery, the responsibility for protecting the product belongs to the buyer. If the right of withdrawal is to be exercised, the product must be unused and returned together with the invoice.

RIGHT OF WITHDRAWAL

The buyer may exercise the right of withdrawal within 14 days from the date of delivery of the product without giving any reason.

PERIOD OF THE RIGHT OF WITHDRAWAL

In service sales, the withdrawal period starts from the date the contract is established.
If the performance of the service has started with the consumer’s approval before the withdrawal period expires, the right of withdrawal cannot be exercised.
Shipping costs arising from the exercise of the right of withdrawal are covered by One Silver Gold.
In order to exercise the right of withdrawal, a written notification must be sent to the seller within 14 days by registered mail, e-mail or written notice.

EXERCISE OF THE RIGHT OF WITHDRAWAL

The buyer must submit the following documents during the return:

• Product invoice
  (For corporate invoiced orders, a return invoice is required for returns.)

• The product must be returned with its box, packaging and all accessories complete and undamaged.

RETURN CONDITIONS

The seller refunds the product price within a maximum of 10 days from the receipt of the withdrawal notice and is obliged to take back the product within 20 days.
If there is a decrease in the value of the product due to the buyer, this amount is collected from the buyer.
If the campaign limit is fallen below after the return, the applied discount is cancelled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal does not apply to the following products:

Products specially produced for the person:

• Name-engraved products

• Custom-sized products

• Custom-designed products

Products that are not suitable for return due to hygiene:

• Earrings

• Piercing

DEFAULT AND LEGAL CONSEQUENCES

If the buyer defaults on credit card payments, the buyer is responsible for interest and expenses in accordance with the bank agreement. The bank may take legal action when necessary.
